Commentary: When he ran for election in 2007, Mimiko was very popular in Ondo State and seen as a rising star in the feisty, and comparatively new, Labour Party. People's Democratic Party (PDP) candidate Olusegun Agagu's initial victory came as a shock to the public and led to a tribunal. On 25 July, the Ondo State Election Petition Tribunal in Akure sacked Agagu after discounting invalid votes in three local government areas. The Tribunal found that Agagu had won 128,669 votes, against Mimiko's 198,269 votes. The Chairman, Justice Garba Nabaruma, declared Mimiko the victor.
